Miland Simpler recently obtained summary judgment in favor of his client, a trucking and freight hauling company, in the Circuit Court of Chilton County, Alabama.
The plaintiff was an independent contractor for the defendant company who was injured on the company’s premises while performing maintenance on an 18-wheeler he had leased from the company. The plaintiff asserted claims of negligence, wantonness, and negligent/wanton maintenance of the company’s premises. The trial court held a hearing on the defendant’s Motion for Summary Judgment, and after consideration of the parties’ briefs and oral argument, the Trial Court ruled in favor of the defendant company and dismissed the case.
