Mobile Partner Monty Montgomery recently obtained a dismissal of all claims in favor of two clients sued for multiple federal civil rights violations and wrongful death.
The clients, who were not police officers or members of any police department, were sued along with several law enforcement officers for unreasonable search and seizure, excessive force, conspiracy, and wrongful death after the decedent engaged law enforcement in an armed standoff for several hours during the spring of 2018. Finding many of the allegations against Mr. Montgomery’s clients “implausible,” the United States District Court granted Mr. Montgomery’s Motion to Dismiss, and the Plaintiff did not appeal.
