Megan McCarthy and Joe Wiley Mitchell teamed to obtain a summary judgment in a wrongful death case pending in the Circuit Court of Dallas County.
The case involved a passenger who died in a motor vehicle accident.
Megan and Joe Wiley asserted the guest passenger statute on behalf of the driver as an affirmative defense barring the estate of the deceased passenger’s right of recovery. The plaintiff sought to overcome the application of the guest passenger statute with a claim of wantonness, which was rejected by the court and summary judgment was thus granted in their favor.
