Montgomery Partner Megan McCarthy recently obtained a defense verdict in a jury trial in the federal court in Montgomery.
Megan defended a claim against a Florida woman which arose out of a motor vehicle accident that occurred in Alabama, while Megan’s client was traveling to Florida. Megan’s client hydroplaned on a rain-soaked highway resulting in a momentary slide without other event. She then saw Plaintiff’s vehicle leave the roadway and hit a tree. The two vehicles did not impact each other. Megan’s client stopped to provide aid to the other driver. The other driver then claimed at trial that Megan’s client forced her off the roadway into the tree resulting in serious personal injuries. Megan successfully rebutted that claim as well as offering proof that the claimed injuries were actually non-existent.
